Terms of Service

Document Revision Date: 12/21/2006

Terms of Service:

  1. The gratis Royal Rangers web hosting plan (hereafter known as the Service), is provided as a means for Outposts to post Outpost related material.

  2. The Service's agents and administrators are hereafter known as the Operators.

  3. An Outpost webmaster or their designated agents are hereafter known as the Users.

  4. Users will have no more than 25MB of space to store their files.  Users over quota may experience random file deletion.

  5. Users who post inappropriate content that is in violation of the spirit of Royal Rangers (this determined by the Operators) may have the material removed from the server(s), their access revoked, or their website taken offline (or all of the above). Determinations of inappropriateness are on the part of the Operators. Inappropriate content could include profanity; hateful speech; nudity, or what may be deemed pornographic content; games, software, or music which may contravene the laws of the Jurisdiction of the Service or Operators, and so on at the discretion of the Operators.

  6. In the interest of keeping the Service's resources evenly spread among all Users, Users who place an undue or inordinate amount of stress or load on the Service's server(s) may be asked to find hosting elsewhere. The Operators will provide a reasonable amount of time for the User to move their files, and will remove the site or content on a date previously disclosed to the User.

  7. Hot-linking is expressly forbidden. Hot-linked content may be removed immediately or User access credentials revoked with no notice or warning.

  8. Users who upload image content that is unnecessarily large (example: an unresized 1MB digital camera image) may have their images automatically or manually resized by the Operators in order to conserve disk-space, bandwidth, or other resources. The Operators will make a good-faith effort to generally preserve the image quality of any resized images. Advance notice and warning is hereby provided of this circumstance.

  9. The Users acknowledge that the Internet is neither owned nor controlled by any one entity; therefore, the Operators can make no guarantee that any given location or IP shall be able to access the Service's server(s) at any given time.

  10. Users acknowledge the homebrew nature of the Service, and distance themselves from having professional expectations of the Service. A homebrew service does not have the resources necessary for redundancy and fail-over that a professional service may. The Operators may take protective steps and take systems offline during lightning storms, or may lose power altogether during blackouts or brownouts. Electronic malfunctions and service disruptions may temporarily sever the Service's connection to the larger Internet, and these things are beyond the control of the Operators.

  11. Users acknowledge that the Service's server(s), data, or operating system may need to be reloaded or upgraded for any number of reasons. It may come to pass that the system or part of the system needs to be restored from a backup data set. The Users acknowledge that no matter how often data is backed up, a restore will always result in the loss of newer data, and the restoration of potentially old data. Users are expected to have the most up-to-date version of their website as a local copy on their own computer. Advance notice of a restore, or notice after the fact, may or may not be provided; this (and the method) is at the discretion of the Operators.

  12. Except as expressly provided otherwise in a written and signed physical agreement between the User and Operators, all site materials and Services are provided "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. Without limiting the foregoing, the Operators make no warranty that the Site Materials and Site Services, if any, or the use of the same (i) will meet the User's requirements, (ii) will be uninterrupted, timely, secure, or error-free, (iii) will garner effective, accurate or reliable results, or (iv) will meet the User's expectations. Some States or Jurisdictions do not allow the exclusion of implied warranties or limitations on how long an implied warranty may last, so some of the above limitations may not apply.

  13. The Users will provide the Service's server(s) with material and data in a condition that is "server-ready", which is in a form requiring no additional manipulation on the part of the Operators. The Operators are not obligated to make any effort to validate this information for content, correctness or usability. Additionally, the Operators do not pledge any help or support with website maintenance.

  14. Users who become “high-maintenance” or who make a disproportionate amount of support calls or e-mails (this determined by the Operator) may be asked to pay a one-time or recurring Support Fee to maintain a support level above what the Operators deem nominal.

  15. The Operators are not in any way, shape, or form obligated to edit, update, add, or remove content from a User's site, wherein this action would normally be the responsibility of the User.

  16. The Operators will provide a “best-effort” Service, however as previously stated this service may be partially or totally unavailable from time-to-time for any amount of time. The Operators will attempt to keep down-time to a minimum, however this is a Gratis service, and neither life, limb, nor sleep will be sacrificed to maintain the availability of this Service.

  17. As part of the provision of the Service, the Operators may take the Service and server(s) offline occasionally for scheduled maintenance (either hardware or software), backup purposes, or because of unforeseen circumstances. Due to the diverse and widespread nature of the Outposts, content may go off-line at a time that is inconvenient for one of the Outposts. These eventualities cannot be foreseen, and the Users hold the Operators harmless.

  18. These Terms of Service may be amended or changed at any time without advance notice.
